These Terms of Service ("Terms") govern your access to and use of (a) the internet radio at pokefm.com ("Radio") and (b) the content publishing platform PokeFM Publisher ("Publisher"), both operated by Sergey Goncharov ("we", "us"). By accessing or using either service, you agree to these Terms.
You must be at least 16 years of age to use the Service. By using PokeFM Publisher you also confirm that you comply with the terms of service of every third-party platform to which you connect your account (TikTok, Meta, Google).
To use PokeFM Publisher you must connect one or more of your social media accounts through the official OAuth flow of the respective platform. You are responsible for maintaining the confidentiality of your platform credentials and for all activity that occurs through your connected accounts. You may disconnect your accounts at any time, either through the Service or directly through the third-party platform's settings.
You retain full ownership of all videos, captions and other materials you upload to PokeFM Publisher ("User Content"). By uploading User Content you grant us a limited, non-exclusive, royalty-free license to store, process and transmit that content solely for the purpose of providing the publishing service you requested.

PokeFM Publisher relies exclusively on the official APIs of TikTok, Meta and Google. We operate within the published terms of service and developer policies of each platform. The Service does not scrape platform content, does not act on behalf of users who have not explicitly connected their account, and does not attempt to circumvent platform rate limits or abuse-detection mechanisms. If a connected platform suspends or revokes API access, related Service functionality may become unavailable.
The Service is provided on an "as available" basis. We do not guarantee uninterrupted, error-free or secure operation. We may modify, suspend or discontinue any part of the Service at any time, with or without notice.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, applicable law, or the terms of any connected platform. You may stop using the Service at any time by disconnecting your accounts and contacting us to delete your data.
To the maximum extent permitted by law, neither we nor our service providers shall be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed EUR 50.
You agree to defend, indemnify and hold us harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or of any third-party platform's terms.
We may update these Terms from time to time. The "Last updated" date at the top of the page indicates the latest revision. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the European Union, without regard to its conflict-of-laws rules.
